I also have a fixed 20-hour contract, but the manager is not giving me shifts without providing proof for his claims. He gave shifts to everyone else but told me there are no shifts available for me. I don’t know what this means—whether it is discrimination because I asked for my rights. He blamed me for tasks that were not part of my normal duties, and nobody trained me for these types of tasks. I also asked who is responsible for the health department’s findings if others are doing their jobs properly. However, management is not willing to listen and instead keeps blaming me for everything. Every time, they compare my work only with the sales, in which I have no contribution. Additionally, I want to know who will be responsible for the minus hours when management does not give me any shifts on the basis of discrimination.

Federal Labor Court (BAG), January 19, 1999 – 9 AZR 679/97 Official Guiding Principle:

  1. According to Section 615, Sentence 1 of the German Civil Code (BGB), the employer must continue to pay the agreed remuneration if they default in accepting the services. The requirements for default in acceptance are governed by Sections 293 et ​​seq. of the German Civil Code (BGB). If a calendar-based payment is made, an offer from the employee is not required for the service to be provided by the creditor if the employer fails to provide the service on time. The Second Senate of the Federal Labor Court defines the employer's cooperation as the provision of a functional workplace for the employee every working day.

  2. As the creditor of the owed work, the employer is obligated to enable the employee to perform the work. To this end, the employer must continuously plan the employee's workload and specify it by providing instructions regarding the location and time of the work. If the employer fails to comply with this obligation, he shall be in default of acceptance without the employee having to make an offer to provide the service (continuation of the case law of the Federal Labor Court (BAG) judgments of 9 August 1984 – 2 AZR 374/83 – BAGE 46, 234, 244 = AP No. 34 to Section 615 of the German Civil Code; of 24 November 1994 – 2 AZR 179/94 – BAGE 78, 333 = AP No. 60 to Section 615 of the German Civil Code).
