The works council can/must instruct the employer to order the colleague to cease and desist immediately from systematically harassing your wife. If the employer fails to do so, the works council may, in accordance with Section 23 of the Works Constitution Act, initiate proceedings before the labour court against the

employer for breach of statutory duties.

Furthermore, under Section 104 of the Works Constitution Act, the works council may apply to the employment tribunal for the colleague who is harassing your wife to be dismissed or transferred to another post.
